TeleHealth Physiotherapy Online Consultation Terms

These terms apply to online physiotherapy consultations purchased through the PhysioWorks website. They should be read with our Privacy Policy and the information on our main TeleHealth Physiotherapy service page.

1. General

We agree to provide physiotherapy services to you on the terms set out in this Agreement. This document represents the entire agreement between the parties, except for terms implied by law that cannot be excluded and any other terms specifically incorporated by reference.

2. Consent

You signify your consent to this Agreement by purchasing any physiotherapy services from the website. We may alter this Agreement from time to time, and you should review this document before each purchase.

If you are under 18 years of age, you must provide written consent from your parent or guardian. Your parent or guardian must also agree to:

  • be bound by this Agreement;
  • provide proper supervision in relation to the information supplied to us; and
  • provide proper supervision in relation to your use of our physiotherapy services.

3. Purpose and Nature of Our Physiotherapy Services

You acknowledge that no online service is a perfect substitute for an in-person consultation with a physiotherapist. TeleHealth may suit selected presentations, but some conditions require face-to-face assessment, medical review, imaging, or urgent care.

You also acknowledge that we cannot guarantee that treatment will resolve your particular complaint or condition. We recommend care that we believe may be appropriate based on the information available, our training, and clinical reasoning.

4. Suitability of Online Physiotherapy

TeleHealth physiotherapy is not suitable for every person or every condition. If it becomes clear that online physiotherapy is not suitable for you, we may decline to provide the service, refund any money paid, and suggest an alternative course of action.

When In-Person Care May Be Better

Book an in-person appointment or seek urgent medical care if you have severe pain, major trauma, unexplained weakness, rapidly worsening symptoms, significant swelling, fever, unexplained night pain, or symptoms that feel unusual for you.

5. Provision of Information by You

We rely on the information that you provide when delivering online physiotherapy services. You agree to provide:

  • accurate and complete information in response to online forms, questionnaires, and follow-up questions; and
  • any information that could reasonably be relevant to your condition, safety, treatment, or exercise advice.

6. Provision of Advice by Us

We agree to provide written information, such as your treatment programme or requested advice, by email within two business days where that forms part of the purchased service.

7. Using Our Physiotherapy Services

Full comprehension required: You must not implement a treatment programme or act on advice unless you fully comprehend the instructions. Please ask questions before starting any exercise, treatment strategy, or management plan.

Stop if symptoms worsen: You must stop using the treatment programme and stop acting on advice if you experience unexpected pain, discomfort, or symptom worsening. In these circumstances, contact us or seek appropriate medical care.

Third persons: You must not provide your treatment programme to another person. We assume no duty of care in relation to third persons who use information that was prepared for you.

8. Liability

Statutory terms: The laws in force in Australia imply certain terms into contracts between consumers and businesses. These include warranties that services are delivered with due care and skill and are reasonably fit for their intended purpose. Nothing in this Agreement is intended to exclude, restrict, or modify those rights where the law does not allow that.

Exclusion: Subject to the statutory terms above and any law that prevents us from excluding or restricting liability, we exclude liability related to your use of our physiotherapy services:

  1. of whatever nature, including indirect, incidental, special, or consequential loss or damage; and
  2. however arising, including negligence, tort, breach of contract, or breach of statutory duty.

Limitation: Where liability cannot be excluded, any liability incurred by us in relation to physiotherapy services is limited to $1,000 unless we specifically agree to another amount with you.

9. Privacy

The PhysioWorks Privacy Policy forms part of this Agreement.

10. Governing Law

This Agreement is governed by the laws in force in Queensland, Australia. You submit to the jurisdiction of the courts in Queensland.

11. Definitions

In this document and the documents incorporated by reference, the following terms have the following meanings unless the context clearly requires otherwise:

Agreement means the terms and conditions of purchasing our physiotherapy services as set out in this document and the documents incorporated by reference.

Business Days means any day other than a Saturday, Sunday, or a day declared as a public holiday under Queensland law.

PhysioWorks means us.

Physiotherapy services means any physiotherapy or health-related services provided by us in return for a fee, including assessment, advice, diagnosis-related guidance, or treatment programmes.

Website means the website located at physioworks.com.au and all sub-domains, folders, and sub-folders on that domain.

12. Interpretation

In this document, unless the context clearly requires otherwise:

  1. The terms “we”, “us”, and “our” refer to services provided via this website, which is owned and operated by Millilodge Pty Ltd as trustee for the SPW Trust, trading as physioworks.com.au (ABN 31 050 404 432), our successors, and assignees.
  2. Words defined in the singular have the corresponding meaning in the plural.
  3. Reference to a “person” includes a corporation, association, or other entity.
  4. Reference to a “written request” means a request submitted to us by email, post, fax, or a website contact form.
  5. Reference to the “parties” means both you and us.
  6. All monetary amounts are expressed in Australian dollars.
